Cheap Windows Key: Legal or Scam? The Real Answer
Microsoft’s online store sells Windows 11 Pro at its full list price, while some European resellers offer it for a small fraction of that. Let’s answer straight away: yes, a key at that price can be perfectly legal, because since the UsedSoft ruling handed down by the Court of Justice of the European Union in 2012, reselling second-hand software licenses has been allowed in Europe, just like reselling a book or a car. The real question, then, is not “legal or not?” but “how do you tell a serious reseller from a scam?”. Here is what explains these prices, what the law actually says, and the practical checks to make before you get your bank card out.
A price gap with an explanation: the second-hand license market
The “too good to be true” reflex is a healthy one on the internet. Here, though, it misses the mark, because these keys are not new licenses sold off at a loss: they are second-hand licenses. A perpetual Windows license is a right of use acquired once and for all. When a company closes down, merges or renews its IT equipment, its licenses remain valid but are no longer of any use to it. Specialist brokers buy them up in bulk, check their origin, then resell them to online stores at a fraction of the price of a new license.
Unlike a car, a license does not wear out: Windows activated with a second-hand key is strictly identical to Windows activated with a new license, with the same features, the same updates and the same unlimited duration. Add the absence of a box, of stock and of a physical distribution network (the key arrives by email), and the price gap is simple economic logic. The end of support for Windows 10 in October 2025 has also amplified the trend: millions of PCs are moving to Windows 11, fueling demand for affordable licenses.
The 2012 UsedSoft ruling, explained simply
On July 3, 2012, the Court of Justice of the European Union settled a dispute between the software publisher Oracle and the German company UsedSoft, which specializes in reselling licenses (case C-128/11). Oracle argued that a license obtained by download could not be resold. The Court ruled the opposite, on the basis of the principle of “exhaustion of the distribution right” set out in Directive 2009/24/EC: when a publisher sells a copy of a piece of software in the European Union with a right of use unlimited in time, it loses the ability to oppose the resale of that copy. Physical medium or download, it makes no difference.
Three conditions frame this legal resale:
- A perpetual license: the ruling covers licenses acquired permanently (Windows 11, Office 2021, Office 2024), not subscriptions such as Microsoft 365;
- A first sale in the European Union or the European Economic Area, made by the publisher or with its consent;
- A copy made unusable by the original seller: the first buyer must uninstall the software at the time of the resale.
This case law applies throughout the Union, in every member state, and no publisher can override it with a contract clause. It applies to Windows as much as to office suites: it is what makes it possible to get Office 2024 Pro Plus for 24,90€, far below the price of a new perpetual edition.
Where exactly do these licenses come from?
Three sources dominate the European second-hand license market:
- Liquidations and restructurings: when a company disappears, its perpetual licenses are among the assets sold off;
- IT equipment renewals: a company that replaces its computers or moves to the cloud no longer has any use for licenses bought a few years earlier;
- Surplus business licenses: batches bought beyond actual needs can be resold, within the limits set by case law.
Between these companies and you, specialist wholesalers buy up the batches, check their origin and resell them to stores. Let’s be honest: this market is still uneven. The legal framework exists, but unscrupulous sellers mix in keys of dubious origin, diverted from restricted channels or bought fraudulently. The choice of reseller therefore matters more than the displayed price, and the following comparison shows why.
Comparison: four ways to get a Windows key
| Where you buy | Typical price | Legality | Main risk |
|---|---|---|---|
| Microsoft Store (new license) | Full list price | Legal | None, apart from the price |
| Established reseller of second-hand licenses | A fraction of the list price | Legal (UsedSoft ruling) | Very low if an invoice and a guarantee are provided |
| Anonymous marketplace, private seller | Next to nothing | Doubtful (stolen or diverted keys) | Key rejected, no recourse |
| Crack or downloaded “activator” | “Free” | Illegal | Malware, compromised system |
The second row is the sweet spot: a cheap and fully legal Windows key, provided you check carefully who you are buying from.
The seven signs of a serious seller
Before paying, look the site over. Seven checks are enough, and they take less than five minutes:
- An identifiable company: a full legal notice with the company name and registration number, which you can check for free in the official business register of its country;
- Reviews on an independent platform: a meaningful number of them, with replies from the seller, including to negative reviews;
- A consistent price: a second-hand Windows key is cheap, but not suspiciously so. When a key costs next to nothing, the goods rarely have a clean origin;
- A VAT invoice: it is your proof of a good-faith purchase and the condition for claiming under a guarantee;
- An explicit guarantee: replacement of the key if it does not activate, ideally for life;
- Reachable support: ask a question before buying and time how long the answer takes;
- Documentation: detailed activation guides and links to the official channels to download Windows legally, never to a file hosted who knows where.
This is the model Euro Shop Key follows: an identified company with a full legal notice, keys delivered by email within minutes, a VAT invoice with every order, a lifetime replacement guarantee on defective keys, and email support 7 days a week with a reply within 2 hours on average. Here, a Windows 11 Pro key costs 9,90€, invoice included.
The red flags that should make you run
Conversely, some signs leave no room for doubt:
- Keys for next to nothing on international marketplaces: often keys paid for with stolen bank cards, developer keys or diverted volume licenses, which Microsoft ends up deactivating;
- No legal notice, or a company that cannot be found in the official registers;
- Impossible promises: a “lifetime Microsoft 365” does not exist, since it is a subscription. Behind this kind of offer there is usually a shared or hacked account;
- Payment only by bank transfer or cryptocurrency, with no possibility of recourse;
- An “activator” to download: no third-party software should ever be used to activate Windows. These KMS-type executables are illegal and a classic vector for malware.
A word about “free”, to be thorough: Microsoft allows Windows 11 to be installed without a key. The system then runs with an “Activate Windows” watermark and with personalization options locked. That is the only legal form of free there is; everything else is piracy. Set against a genuine license at 9,90€, the choice is quickly made.
Key not accepted: what to do
Even a legitimate key can be refused on the first attempt: wrong edition, a typo, a temperamental activation server. Work through these steps in order:
- Check the installed edition: a Windows 11 Pro key will not activate Windows 11 Home, and vice versa. This is the leading cause of failures. If in doubt, our Windows 11 Home vs Pro comparison helps you identify your version;
- Type the key in again by hand, without copying and pasting it from the email, which sometimes adds an invisible space;
- Note the error code (0xC004C003 and 0xC004F050 are among the most common) and read our Windows 11 activation guide, which details the fixes case by case;
- Try phone activation: press Windows + R, type “slui 4”, choose your country or region and follow the instructions. This channel resolves many situations;
- Contact the seller’s support with the error code and a screenshot. A serious reseller replaces the key without any fuss: that is the very purpose of the guarantee;
- As a last resort, open a dispute with your bank, and report the site to the consumer protection authority in your country.
Frequently asked questions
Is it legal to buy a cheap Windows key in Europe?
Yes. Reselling second-hand software licenses has been legal throughout the European Union since the Court of Justice’s UsedSoft ruling (case C-128/11, July 3, 2012), provided the license is perpetual and was originally sold in the EU. Buying a second-hand Windows key from an identified reseller, with an invoice, is therefore perfectly legal.
Why does Microsoft charge full price for Windows 11 Pro when some sites sell it for a fraction of that?
Microsoft sells new licenses at its public list price. Specialist resellers buy back perpetual licenses already sold in Europe (IT equipment renewals, company liquidations) and resell them in digital form, with no box and no physical distribution. Once activated, the resulting Windows is identical in both cases.
Can Microsoft deactivate a cheap key later on?
A license of legitimate origin is perpetual and stays that way. Deactivations mainly concern diverted keys sold for next to nothing on anonymous marketplaces. That is why an established reseller’s lifetime guarantee matters: if a problem ever occurs with a key, it is replaced free of charge.
What should I do if my Windows key won’t activate?
Check that the installed edition matches the key (Home or Pro), try phone activation with the “slui 4” command, then contact the seller’s support, giving the error code. A serious seller replaces the key; if they do not respond, open a dispute with your bank.
